
Land is a precious resource of Cambodian people for the developments covering approximately 18.9 millions hectares of the total area. The land occupied by private sectors is comprised of around 3.6 millions hectares equivalent to 20 percent compared to 14.5 millions hectares of the land run by the State.
But the Royal Government also pushed for the planning of land usages in order to be allocated for development, agriculture, industry, tourism, and urban, rural, housing, reserved and conserved areas in order to circumvent non-potential usages of land. The Royal Government of Cambodia paid its attention to enforcement of safety of occupying the State land, private land and ethnic minority association’s land through systematic and separated registrations. Cambodia also opened for any foreigners who wish to live and have their private ownerships by making a law on the provision of ownership on the private portion of the co-ownership building to foreigners, in which this law contains seven chapters and 24 articles, by broadening scopes of the provision to foreigners regardless of what the nationality, belief, religion and origin of race of the concerned foreigners are. Therefore, foreigners can have their ownerships on private portions, being possibly eligible to conduct any procurement such as sale, exchange, donation, succession, permanent rent or lease, hypothec and pawning when they become an owner on private portions of the co-ownership building from the first floor and above, whereas on the ground floor, the law doesn’t permit any foreigners to run their ownerships and doesn’t also allow any foreigners to gain access to the private portion of the co-ownership building within the distance of 30 kilometers from the land border. The co-ownership buildings having private portions contains villas, semi-villas, flats with several flats, condos and other kinds of houses with a series of structures. We hereby confirm you that the private portions mentioned in this regard mean that co-owners have no more portions than 70% of the land size of all private portions of the co-ownership building, and another 30% is a common portion which all co-owners of the co-ownership building can still utilize and enjoy those common portions as well, including land, courtyards, steps, parks, gardens, routes, entrance-exit, indivisible-joint walls, and places of common services. All co-owners residing in the co-ownership building are also entitled to create internal regulations in order to facilitate harmony for all co-owners who use the co-ownership building.
Section 2: Procedure of Wedding between Khmer citizens and Foreigners
This procedure has target for limiting forms or manners of wedding in the Kingdom of Cambodia between Khmer citizens and foreigners in conformity with sub-decree No: 183 dated on November 3, 2008 by respecting voluntary principles and personal will of the concerned person, and doesn’t allow dating agents, brokers or business companies to conduct any operation on wedding between Khmer citizens and foreigners, and with regard to disguised or fraudulent marriage with the intention of exploitation, human trafficking or sexual exploitation, any foreigners who wish to get married to Khmer citizens must be categorically present in the Kingdom of Cambodia where requires fulfillment of certain application forms proved of innocence and lawful validity. We will offer conditions and forms which the concerned Khmer citizens and foreigners shall complete as follows:
- As for Khmer citizens, they must apply for a wedding to the commune civil registration officers of their permanent address where they live by attaching the following document files:
- Application for Marriage
- Copy of birth certificate or copy of birth or a copy of the concerned person’s birth certificate
- Certificate of singleness, widower or widow issued by the commune chief of the permanent address of the concerned person.
- Certificate of health issued by medical officials and officially recognized by the Ministry of Health of the Kingdom of Cambodia - As for the foreigners, they must fill in the application form to the Ministry of Foreign Affairs and International Cooperation of the Kingdom of Cambodia by attaching the following documents:
- Application for marriage
- Copy of the concerned foreigner’s passport with a valid visa proved of entering Cambodia
- Certificate of singleness, widower or widow issued by the jurisdiction of the concerned foreigner’s country
- Certificate of health issued by the jurisdiction of the Kingdom of Cambodia
- Criminal record issued by the jurisdiction of the concerned person’s country
- Certificate of the concerned person’s real occupation guaranteeing livelihood issued by the jurisdiction of the concerned person’s country
NOTE : Copies of a passport and certificate of singleness, widower or widow shall be proved of the legality by the embassy or consulate of the concerned person’s country to the Kingdom of Cambodia. An application for marriage and file of the concerned person proved of being Khmer nationality and foreigner shall be filed at the same time to the commune civil registration officers of the concerned Khmer citizen’s permanent address in compliance with the application form and procedures of the civil registration work.
